CUOMO – a Democratic Scion now considered the current frontrunner in the New York City Democratic mayoral primary in June – was introduced to the Biden Department of Justice in October 2024 for criminal prosecution. Covid-19 nursing home death scandal.
In a new letter to Attorney General Pam Bondy on Monday, Comer said, “To our knowledge, the Biden administration ignored this introduction despite clear facts and evidence.” He asked Bondi to review the referral and “take appropriate action.”

“Andrew Cuomo is a man with a history of corruption and deception, and has now been caught lying to Congress during an investigation by some subcommittees on the tragedy of Covid-19 nursing homes in New York,” Comer said in a statement Monday. “This was not a slip-up. It was a calculated cover-up by a man trying to protect himself from liability for the devastating loss of life in a nursing home in New York. Let's be clear: Lieing to Congress is a federal crime. Cuomo must be charged to the fullest extent of the law.
Cuomo spokesman Richard Azzopardi reached out to Fox News Digital's comments. Comer's letter rejected, “Last year was nonsense and now it's just more pure press releases.”
“This kind of transparent attempt at this kind of election interference and legal battle is violating its own policies, as the DOJ constantly reminds people,” Azzopardi said. “These referrals are also made to planned parent-child relationships, Hillary Clinton and Anthony Forsey, but the only point to doing this is politics, as there is no need to resubmit with the new administration.”

The CUOMO administration issued an order on March 25, 2020, requiring nursing homes to recognize or reapprove potential Covid-19 patients. The New York State Department of Health (NYSDOH) published a subsequent report on July 6, 2020, entitled “Factors Related to Nursing Home Infection and Death in New York State During the Covid-19 Global Health Crisis.” The report alleges that instead of the March 25th directive, nursing home staff caused excessive Covid-19 deaths in the nursing home.
Comer said witness testimony and new documents revealed in the introduction of the Selection Subcommittee showed that Cuomo “drafted and edited this part of this independent, peer-reviewed report personally.”
New York Attorney General Leticia James said in a January 2021 investigation report that the Cuomo administration may have embedded up to 50% of the total number of deaths in nursing homes.

Some subcommittees began their investigation in May 2023. This issued a subpoena of Cuomo's testimony in March 2024 after a few months of delay.
Cuomo sat in an interview that was transcribed on June 11, 2024. He later testified before the subcommittee selected on September 10, 2024.
Wenstrup said it claimed that Cuomo was not involved in drafting or reviewing the July 6 report. Cuomo also testified that he had not discussed the July 6 report being peer reviewed and that he had no idea whether the July 6 report was reviewed by someone outside of NYSDOH. In all three accounts, WenStrup said the documents obtained by the Selection Subcommittee indicate that Cuomo's statement is false.

It is unclear whether the Justice Department, currently under Trump's control, will pursue action against Cuomo. Fox News Digital reached out to DOJ on Tuesday for comment.
The DOJ moved to dismiss the indictment brought under Biden against current New York Mayor Eric Adams. The judge agreed to abandon the case earlier this month for bias. Adams runs independently in the mayoral primary.
