Georgia District Attorney Fani Willis is expected to veto a Georgia Senate subpoena to testify ahead of a hearing on Friday, according to information obtained by Fox News Digital.
The Senate Select Investigative Committee, chaired by Republican state Sen. Bill Cowsert, has subpoenaed Willis to compel testimony in connection with the committee's investigation into allegations that he misused taxpayer funds.
In an interview with Fox News Digital, Cowsert said the committee issued the subpoena because Willis refused to testify voluntarily, adding that his lawyers told the committee that Willis did not intend to comply with the subpoena.
“I think it's unlikely she'll appear in court, but it's unfortunate that she thinks she's above the law,” Cowart said.
Fani Willis has faced setbacks in her lawsuits against Trump, with the latest case now before the Supreme Court.

If Willis does not appear at Friday's hearing, the state Senate will try to compel her to appear through a judicial order that will be worked through the courts over the coming weeks.
“We have investigative powers, we have the power to issue subpoenas to compel testimony and documents, and those powers will stand if tested in a court of law,” Cowsert said.
“She will be required to appear in court and provide certain documents that are requested. She may need a court order to comply with that, but that's the direction we're heading.”

At Friday's hearing, former Georgia Senate Clerk David Cook is scheduled to speak about the legislative branch's investigative powers and ability to issue subpoenas.
Legislative Counsel Stuart Morelli is also scheduled to testify about the committee's legal authority to conduct investigations and subpoena individuals for testimony and documents.
The Republican-led committee was created by a resolution passed in January by a 30-19 vote.
Willis, who is spearheading the massive prosecution case against former President Trump, has been under intense scrutiny since she was accused in February of having an “inappropriate” relationship with special counsel Nathan Wade, whom she hired to help prosecute the case.

She is currently appealing Fulton County Superior Court Judge Scott McAfee's decision not to remove her from the case, with a hearing scheduled for December.
The Georgia Senate committee has already held several hearings, including one featuring a whistleblower who claims she was fired after raising concerns about alleged misuse of funds by Willis' office.
Willis said in May he didn't believe the committee had subpoena power and told reporters he “won't appear for anything illegal.”

“I have not broken the law in any way,” Willis told reporters at a press conference in May. “It's unfortunate that there are people who are upset that everyone should be treated equally.”
But Cowsert said committee members “are all very confident that they are acting within the constitutional and legislative authority of the state senate.”
A representative for Willis did not respond to Fox News Digital's request for comment.
The hearing begins at 10 a.m. ET on Friday.
