Slusser previously joined a lawsuit against the NCAA represented by former NCAA swimmer Riley Gaines over the governing body's policies on gender ideology that have allowed transgender athletes to compete as women.
In both lawsuits, Slusser claimed Fleming's spike speed was 80 mph.
“Brooke estimates that Fleming's spike was in excess of 130 miles per hour, which is the fastest she has ever seen a woman hit a volleyball,” Slusser's complaint states. “It was.” “Although the girls were doing their best to avoid Fleming's spikes, they were still unable to fully protect themselves.”
Fleming previously set a single-game record at John Champe High School with 30 kills in a game, and set a single-season record for the school's girls volleyball team with 266 kills.

Despite the lawsuits and controversies, Slusser and the rest of his teammates took to court with Fleming during a season that included several forfeits.
San Jose State finished with a conference record of 12-6 and earned the No. 2 seed in the Mountain West Tournament. The team achieved six of its 12 wins by forfeit as Utah, Boise State, Nevada and Wyoming all declined to join the program amid ongoing controversy surrounding Fleming. Boise State and Wyoming State each forfeited two games against San Jose State.
Fleming's spiking ability has been central to the team's strategy in games thus far. Even Thrasser was involved in a lawsuit alleging safety concerns about Fleming, one of the cleats feared by athletes all season.
The team is preparing to play in the Mountain West Tournament this week in Las Vegas, where it will face a team that has already forfeited its game against San Jose State.

Slusser previously told Fox News Digital that he did not know whether the Spartans' upcoming tournament opponents would play against them.
“Our biggest question is, if we go there, will teams play us? Because of everything that's happened this season. '' Slusser said. “Every few days it seems like the weather is nice and everything is normal, and then something else happens.
