Rep. Elise Stefanik filed a lawsuit against New York State Supreme Court Judge Juan Marchan for ethics violations over “unlawful conflicts of interest in the Manhattan sham trial against President Trump,” alleging that the Harris campaign has an “active new financial relationship” with a company partly owned by Marchan's daughter.
The filing with the New York State Commission on Judicial Conduct was filed the same day that Judge Marchan decided to postpone Trump's sentencing in New York v. Trump until after the November presidential election.
After a six-week trial that stemmed from an investigation by Manhattan District Attorney Alvin Bragg, Trump was convicted of all 34 counts of first-degree falsifying business records in an unprecedented criminal trial.
However, Rep. Stefanik is now calling on the committee to “open a new investigation into Judge Marchan's conflict of interest and take appropriate action as a result.”

“On August 20, 2024, VP Harris' Campaign filed its first Federal Election Commission (FEC) report documenting expenses and contributions through July 31, 2024. The report lists a July 30, 2024 expenditure of $468 from VP Harris' Campaign to Authentic Campaigns, Inc. (Authentic) for web hosting services,” Stefanik wrote in the complaint. “This indicates that one of Ms. Harris' first acts upon taking over the Biden campaign's infrastructure was to hire Authentic.”

“Authentic is a digital consulting and marketing firm serving Democratic candidates. Its president is Lauren Marchan, daughter of Judge Marchan,” Stefanik added. “Vice President Harris switched web hosting providers from AWS to Authentic shortly after becoming a leading candidate for the Democratic presidential nomination.”
“Regardless of the amount of the refund, this is just the beginning of a new contract with a new campaign, which of course will generate immediate profits, but is targeted at potentially greater profits for Authentic and Merchant in the future,” Stefanick said in the complaint.

Stefanick continued, “The code of conduct states that judges must recuse themselves from a case if a relative within the sixth degree of kinship has a financial interest in the outcome of the case.”
“Mr. Marchan is a first-degree relative to Judge Marchan. Authentic has an active and emerging financial relationship with Vice President Harris' campaign,” Stefanik concluded.
