Texas Attorney General Ken Paxton began a US Masters' Swimming Survey after a biologically male trans competitor won five women's events at an event in San Antonio at the end of April.

Multiple female competitors told Fox News Digital after the competition that they didn't even know that the trans athlete was a biological male.

Paxton's office is taking action as Texas has laws in place that prohibit trans athletes from competing in women and girls' sports.

“The US master swimming policy that allows men to compete in women's events has been condemned and could violate Texas consumer protection laws,” Paxton said in the announcement. “This policy not only shows disgrace to female athletes, but also shows a deep, light emptying against women, and could violate Texas law. I will never step back from fighting to stop these unfair policies and defending the integrity of women's sports.”

Anacarda, 47, a trans swimmer, dominated all five races that athletes competed with, winning gold in the 45-49 women's categories in five races, including 50 and 100 yard breaststroke, freestyle and 100 yard individual medleys.

Louisiana woman and longtime swimmer Wendy Enderle said she submitted a request for a eligibility review after learning that one of the competitors she has faced for years is transgender, via a news article derived from last week's incident.

Now Endal is grateful to have seen Paxton's office take action.

“Texas Attorney General General General Ken Paxton was extremely encouraged by the announcement that he was starting an investigation into Us Masters Swirming after he allowed transgender swimmers to unfairly compete with me and fellow female swimmers in San Antonio last month,” Enderle told Fox News Digital.

Female swimmers should speak up and file a complaint after unconsciously facing a trans competitor: “I feel betrayed.”

Endal also hopes that the US Department of Justice will take action. President Donald Trump has introduced an executive order since February 5th calling for publicly funded agencies to ban trans athletes from women and girls' sports. However, USM is not publicly available.

“We hope that US Masters Swimming will quickly adopt more appropriate and fair policies in line with global aquatics policies. We also hope that US Attorney General Pam Bondi will protect men from women's sports dated February 5, 2025 and see if US Masters violates President's Executive Order No. 14201,” added Endel.

“I am not a legal expert, but my opinion is that USMS is in violation of this order as it is a sports association and sports-specific governing body referenced in order.

In June 2023, Texas passed the Save Women's Sports Act. This prohibits trans athletes from competing in women's sports and women's sports, allowing students to compete only in the gender categories listed on their birth certificates. The law allows schools to recognize changes made to birth certificates that have been made to correct administrative errors.

More laws aimed at protecting women from incorporating trance into sports can also be signed quickly in Texas.

Earlier this month, the Texas Senate voted to pass the Texas Women's Privacy Act by voting 20-11. The bill ensures that women are safe in bathrooms, locker rooms, showers and domestic abuse shelters.

Meanwhile, USMS policy allows transgender swimmers to participate in the gender competition categories they identify if certain conditions are met.

One of the two conditions requires continuous and uninterrupted administration of hormone therapy in a manner that cannot be properly verified for more than a year. Another condition is evidence of testosterone serum levels measured over the past 12 months, below 5 nmol/L (144.25 ng/dl).

Trans swimmers who do not meet these requirements are still able to participate in the female category, but those times will be removed from the results submitted and will not be subject to official times, locations, points, records, top 10 or other official recognition.

Fox News Digital has contacted USMS about a pending investigation of comments.
